For most people, divorce is an unknown. They are uncertain and concerned about how and what assets will be divided. Will they be left with nothing after years of marriage? What about spousal support? Child custody? Child support? We are here to answer your questions and guide you through the uncertainty you are facing.

  • Division of assets: According to Mississippi law, marital assets are subject to equitable distribution. Both spouses are presumed to be equal and to be entitled to an equal share of the assets accumulated during a marriage. If there is likely to be a fight over assets; confusion about stock options, 401(k), retirement benefits, IRA, pension, real estate; or if there is a business that needs to be divided, make sure you have a divorce lawyer with strong negotiation and trial experience.
  • Nonmarital assets: Inherited assets or assets owned prior to the marriage still belong to the owner. Often, however, nonmarital assets have been commingled or maintained using marital assets. Determining what are marital and nonmarital assets can be complex.
  • Hidden assets: If one spouse fails to disclose certain marital assets, our law firm uses experts, such as CPAs to determine whether such assets exist, where they are located, and what they are worth.
  • Alimony (spousal support): Will your divorce involve spousal support? A number of factors will be considered, including the length of the marriage, expenses, the earning capacities of each spouse and misconduct.
  • Child custody and support: Who will have custody of the children? What will child support be? We can explain the law.
  • Attorney's fees: We do require a retainer in divorce cases. If your spouse has made funds unavailable to you, let's meet and discuss your ability to pay and your options.
